Terms of Service

These Terms of Service (“Terms”) govern your use of the graphic design services provided by Kathryn Collett (“we,” “us,” or “our”).

By engaging in any project or communication with us, you agree to these Terms.

1. Services Provided

We provide graphic design services, including but not limited to logo design, branding, digital art, print design, and consultation. Specific services and deliverables will be outlined in the contract or proposal provided for each project.

2. Payment Terms

  • Rates: Our rates are outlined in the project proposal. Rates may vary depending on the scope of work, complexity, and project deadlines.

  • Deposits: A non-refundable deposit, as outlined in the contract or proposal provided for each project, is required before starting work on any project. The remaining balance is due upon project completion, prior to final delivery of files.

  • Late Payments: Payments not received by the due date may incur a late fee of 20% per month. If payments are overdue for 10 days, we reserve the right to suspend or terminate work.

3. Project Deliverables

Upon final payment, you will receive the agreed-upon design files in the formats outlined in the project agreement. These may include .AI, .PSD, .INDD, .JPG, .PNG, .PDF, etc.

4. Revisions and Scope of Work

  • The scope of work is defined in the proposal and contract. Any changes or additions to the scope, including additional rounds of revisions, may result in additional charges and an amended project timeline.

5. Ownership and Intellectual Property

  • Upon full payment, you will own the final deliverables (design files). However, we retain the right to showcase the completed design in our portfolio and marketing materials.

  • You may not resell or distribute the final design files without our consent unless agreed upon in writing.

  • We reserve the right to use any preliminary concepts or drafts created during the design process for portfolio purposes.

6. Client Responsibilities

You agree to:

  • Provide accurate and complete information about your project.

  • Respond to communication and feedback requests in a timely manner.

  • Ensure that the content you provide does not infringe on any copyrights or intellectual property rights.

7. Termination

Either party may terminate the project with written notice. If the project is terminated by the client, any work completed up to that point will be billed at the agreed-upon rate, and any deposits will be non-refundable.

8. Limitation of Liability

We are not liable for any indirect, incidental, special, or consequential damages arising from the use of our services. Our total liability for any claim related to these services will not exceed the total fees paid for the project.

9. Dispute Resolution

Any disputes arising out of or related to these Terms will be resolved through mediation or arbitration in Contra Costa County, California. You agree that any claims will not be heard on a class-wide basis, unless required by law.

10. Changes to These Terms

We reserve the right to modify these Terms at any time. Any changes will be effective immediately upon posting on this page, and the “Last Updated” date will be revised accordingly.
